Travel Services Agreement
Effective Date: 01-03-2025.
Welcome to Planet Venture Discoveries.
This Travel Services Agreement (the“Agreement”) sets forththe terms and conditions (the “Terms & Conditions”) under which Planet Venture Discoveries (the “Consultant”), shall provide travel-related consultancy services to you, (the “Client”).
By accessing the Consultant’s website and engaging Consuktant’s services, the Client acknowledges that they have read, understood and agreed to be legally bound by the Terms & Conditions set forth herein. If the Client does not agree to any of the Terms & Conditions contained in this Agreement, they must immediately discontinue the use of the Consultant’s services.
- Age Requirement
By making a booking or engaging the Consultant’s services, the Client represents and warrants that they are at least 18 years old and legally capable of entering into this Agreement.
- Scope of Services
The Consultant offers a range of travel consultancy services, including but not limited to:
- Customized Travel Experiences
- Travel Planning and Itinerary Development
- Booking Assistance- assisting in the reservation and procurement of flights, accommodations, and transportation
- Travel Advice and Recommendations
- Documentation and Visas Assistance
The Consultant does not act as a travel agency, airline, hotel, or tour operator and does not directly issue tickets or reservations unless expressly agreed upon in writing.
- Client Responsibilities
The Client agrees and acknowledges that they shall:
- Provide the Consultant with accurate, complete, and up-to-date personal and travel information necessary for the performance of Consultant’s
- Review all travel arrangements, itineraries, confirmations, and othr documents provided by the Consultant and immediately notify the Consutant of any discrepancies or required modifications.
- Be responsible for obtaining all required travel documentation, including passports, visas, vaccinations, and any other necessary permits.
- Assume all risks associated with travel, including but not limited to health risks, flight delays, political instability, and force majeure events.
Adhere to all applicable laws, customs, and travel regulations of their destination. - Committing any illegal act may result in immediate removal from a tour or travel service, and the Consultant shall not be held responsible for any penalties, fines, or legal consequences incurred by the Client.
Fees and Payment Terms
- The Consultant’s fees for services rendered shall be outlined in a separate proposal or invoice provided to the Client. .
- Payment shall be upon receipt of the invoice unless an alternative arrangement has been mutually agreed upon in writing.
- All fees paid to the Consultant are non-refundable, except as explicitly agreed upon in writing
Cancellation and Refund Policy - Refunds for services rendered will be considered on a case-by-case basis and at the sole discretion of the Consultant.
- Cancellations must be made in writing by the Client and may be subject to cancellation fees as outlined in our proposal or invoice at least ten (10) days prior to start of the trip.
- The Consultant shall not be responsible for any fees, penalties, or costs incurred by the Client due to cancellations, modifications, or failure to comply with airline, hotel, or other travel-related service provider policies.
- Limitation of Liability
- The Consultant shall not be liable for any direct, indirect, incidental, or consequential damages arising from the Client’s use of Consultant’s services or any travel arrangements made on Client’s behalf, including but not limited to:
- Loss of funds due to travel disruptions, cancellations, or delays
- Changes in government regulations affecting the Client’s ability to travel
- Health-related incidents occurring before, during or after travel
- The Consultant does not guarantee the performance, reliability, or availability of third-party services, including but not limited to airlines, hotels, tour operators, and transportation providers.
- The Consultant strongly recommends that the Client purchase comprehensive travel insurance to protect against unforeseen circumstances, including medical emergencies, trip cancellations, and lost luggage. In the event that the Client chooses not to obtain such insurance, the Client assumes all associated risks and agrees that the Consultant shall have no liability for any losses, damages, or expenses arising from such circumstances.
- Force Majeure
The Consultant shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, airline strikes, war, terrorism, civil unrest, or failures of suppliers or third-party service providers. The Consultant shall use reasonable efforts to mitigate the impact of such events but shall not be obligated to issue refunds or compensate for losses incurred due to force majeure events.
- No Guarantee of Availability Clause
The Consultant does not guarantee the availability of flights, hotels, or other travel-related services at the time of booking. All reservations are subject to availability and confirmation by third-party providers. Prices and schedules may change without notice, and the Consultant is not responsible for any changes imposed by third-party service providers.
- Intellectual Property Rights
Any itineraries, travel guides, recommendations, or materials provided by the Consultant are the exclusive intellectual property of the Consultant. The Client may use these materials for personal travel purposes only and may not reproduce, distribute, or share them for commercial purposes without prior written consent from the Consultant.
- Client Conduct & Code of Behavior
The Client agrees to conduct themselves in a respectful and lawful manner while engaging in travel services facilitated by the Consultant. The Consultant reserves the right to refuse service or remove any Client from an itinerary or booking without refund and/or blacklist the Client if the Client’s behaviour:
- Is disruptive, abusive, or dangerous to other travellers, Consultant representatives, or third-party providers.
- Violates local laws or customs.
- Creates undue risk to themselves or others.
- Images & Marketing
While participating in any of the Consultant’s travel services, the Client acknowledges that images, photographs, or videos may be taken for marketing and advertising purposes. The Client consents to such images being taken and grants the Consultant and its affiliates a perpetual, royalty-free, worldwide, irrevocable license to use these images for any purpose, including but not limited to:
- Marketing and promotional materials
- Advertising campaigns
- Social media, websites, and other digital platforms
- The Client waives any right to compensation or approval regarding the use of such images.
- Currency & Exchange Rate Disclaimer
Any prices quoted in foreign currencies are based on exchange rates at the time of booking and are subject to fluctuations. The Consultant is not responsible for changes in exchange rates that may affect the final cost of travel services. The Client is responsible for any applicable currency conversion fees charged by their bank or payment provider.
- Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of (Please recommend a jurisdiction when the consultancy is registered in Orange County California).
- Any disputes arising from this Agreement shall be resolved in the courts of (recommend).
- Amendments
The Consultant reserves the right to amend this Agreement at any time. Any changes will be posted on our website, and Client’s continued use of Consultant’s services after such changes constitutes Client’s acceptance of the new Terms & Conditions .
